Terms and conditions of sale

0. INFORMATION PRIOR TO CONTRACTING.

0.1 These general conditions (the "General Conditions"), together, where applicable, with any particular conditions that may be established (the "Particular Conditions"), shall expressly regulate the access, use and commercial relations between the user (the "Client") and the Mesabliss point of sale (the "Point of Sale") through which the Client formalizes the purchase of the products offered during their availability period (the "Products") through the commercialization platform accessible on the website www.mesabliss.es (the "Online Channel") owned by Erasmus Expo S.L. with CIF B56193147 and registered office at Av. Meridiana 350, 11 D, 08027 Barcelona, Spain. The company is registered in the Commercial Register of Barcelona, Volume 48905, Folio 134, Page B600438, Entry 1.
 
0.2 These General Conditions shall remain in force and be valid for as long as they are accessible through the Online Channel. Erasmus Expo S.L. reserves the right to replace at any time both the General Conditions and the Particular Conditions (the "New Conditions"), as well as all legal notices, guidelines and/or usage regulations included in the Online Channel which, as the case may be, will replace, complete and/or modify the General Conditions set forth herein. The Client will be subject to the General Conditions in force at the time of placing their order. Their temporary validity coincides with the time of their exhibition, until they are totally or partially modified. The New Conditions will be applicable from the moment they are made available to the Client.
 
0.3 In case of contradiction between the terms and conditions expressed in these General Conditions and the Particular Conditions, the conditions agreed in the latter instrument shall always prevail with respect to those incompatible terms, and only with respect to those Products subject to such specific conditions.

1. PARTICIPANTS

1.1 "Client" shall mean individual consumers residing in peninsular and insular Spanish territory (with the exception of Ceuta and Melilla) who are of legal age and possess a National Identity Document (D.N.I.) or Foreigner Identification Number (N.I.E.) or legal entities that duly prove their status and accept these General Conditions and the Particular Conditions that, where applicable, are applicable. The purchase of Products on the Mesabliss Online Channel by minors, users who do not legally reside in Spain, or users who do not meet the requirements set forth in these General Conditions is expressly prohibited.

1.2 The "Point of Sale" will be the entity that owns the establishment that the Client has chosen when formalizing their order, and with whom the sale of the requested Products will be understood to have been concluded. The corporate data of each of the Points of Sale responsible for the sale will be duly identified during the contracting process.

 

2. ACCESS AND USE OF THE ONLINE CHANNEL.

2.1 Access to and use of the Online Channel is free of charge, with Mesabliss reserving the right to demand a consideration for it in the future.

2.2 For the purchase of Products through the Online Channel, Mesabliss will ask users to register, for which said Clients must fill in the electronic form that appears on the Online Channel at any time, following the instructions indicated therein. In this registration process, exact and true data must always and only be provided.

2.3 Mesabliss will send a registration confirmation to the email account designated by the Client for this purpose. The username and password are enabling elements to access and make purchases and are confidential, personal and non-transferable. The username cannot be modified by the Client, but the password can, in which case the modified keys will lose their validity.

The Client will be responsible for the proper custody and confidentiality of the password, not being able to transfer its use to any third party, whether temporary or permanent, nor to allow its use by any third party under any circumstances. The Client must immediately inform Mesabliss of any access to the Online Channel that any third party other than the Client may make using their password.

2.4 All acquisitions of Products purchased through the Online Channel, after identification and authentication, through the username and password provided, will be considered validly made by the Client, and will be binding. Consequently, the Client will be exclusively responsible for any purchases of Products through the Online Channel by any third party who uses their data and password. Orders placed from the Online Channel by a minor who falsifies registration information will be understood to have been made under the supervision and authorization of their parents, guardians or legal representatives.

2.5 The use of the Online Channel and/or the contracting of any of the Products implies acceptance by the Client, without reservations of any kind, of each and every one of the General Conditions as well as, where applicable, the Particular Conditions that may apply. If you decide not to accept these General Conditions, the Particular Conditions and/or, where applicable, the New Conditions, you must refrain from accessing and/or using the Online Channel. The provision and use of the Online Channel by the Client shall be understood, in any case, subject to the strict compliance by the Client of the terms set forth in these General Conditions and, where applicable, in the Particular Conditions that may apply.

2.6 The legal relationship derived from registration as a Client of the Online Channel has an indefinite duration. Either party may unilaterally terminate or suspend this contractual relationship at any time and without further cause than its will to do so, without prejudice to the obligations arising from the formalization of orders prior to the termination of the relationship. The Client may unilaterally exercise the right of termination through the account cancellation process.

 

3. INFORMATION AND AVAILABILITY OF THE PRODUCTS OFFERED.

3.1 The Products offered on the Online Channel, along with their essential characteristics and price, will appear on the screen. In addition to the price, and before confirming the order, any possible shipping costs to the Client's address will appear on the screen. The application of shipping costs will depend on the total amount of the order. Offers will be duly indicated on the screen. The Point of Sale reserves the right to decide at any time which Products are contained and offered to Clients through the Online Channel. In this way, the Point of Sale may at any time add new Products to those included in the Online Channel, it being understood, unless otherwise provided, that such new Products will be governed by the provisions of the General Conditions in force at that time. Likewise, the Point of Sale reserves the right to withdraw or cease to offer, at any time, and without prior notice, any Products offered on the Online Channel.

3.2 For each purchase operation, an order can be placed without a maximum number of units of the same product. All orders and purchases made through the Online Channel are subject to the effective stock availability of the Products at the time the order is prepared for shipment.

3.3 If any of the Products in your order are unavailable, Mesabliss will contact the customer to inform them, and they can choose to receive the order with the available products or cancel the entire order.

 

4. PRICES AND SHIPPING COSTS.

4.1 The prices of the Products are always shown in euros and will be subject to VAT and any other applicable taxes, and will always be those in force.

In some cases, Product prices are also shown with and without VAT. If Mesabliss or the Point of Sale identify a manifest error in the price of the Products, they will inform the Client, and the Client will have the option to reconfirm their order at the correct price or, failing that, cancel it.

4.2 The price of the product does not include shipping costs. Depending on the total amount of the order, shipping costs are borne by the Client and will be added to the total amount of the selected Products. The website clearly indicates the amount from which shipping costs are free or when they must be paid by the Client. The Client will be duly informed about these costs, which will be specified before payment, before confirming the order and completing the contracting process.

4.3 The prices shown on the Online Channel apply exclusively to the Products offered through said Channel and for as long as they remain published. Mesabliss expressly reserves the right to modify prices at any time without prior notice. However, in any case, the rates in force indicated on the Online Channel at the time of placing the corresponding order will apply. The prices published on the Online Channel may differ and be distinct from the prices of the same Products offered and sold in the establishments of Mesabliss's distribution network for direct purchase in those establishments.

 

5. PURCHASE PROCESS.

5.1 To proceed with the purchase of Products, you must add the product you wish to purchase to the Shopping Cart, according to the indications on the screen, filling out the order form provided for this purpose.

5.1 Once the purchase has been made, the necessary data for shipping and invoicing will be requested. As well as payment details and methods. Once the purchase has been formalized, the Client will be sent a confirmation of the purchase made to the email address indicated for this purpose by the Client, which will serve as proof of the operation "Purchase Receipt". Likewise, the client can consult and/or download the invoice in the My Orders section. The order confirmation and the Purchase Receipt will not be valid as an invoice.

5.3 The purchase will be understood to have been made at Mesabliss's registered office.

 

6. PAYMENT METHOD.

6.1 To proceed with payment, the Client must follow each and every one of the instructions shown on the corresponding page of the Online Channel. Payment of the price of the Products and shipping costs can only be made using credit or debit cards or other payment methods indicated on the corresponding page at any given time. Such payment methods will be subject to checks and authorizations by the issuing entities, but if said entity does not authorize the payment, the initiated purchase procedure cannot continue, the order being automatically canceled, and the sale of the requested Product or Products being understood as not having taken place. The charge for the price of the Products, the costs of the shipping service - if applicable - as well as any applicable taxes, will be made at the time the order is formalized.

6.2 As an electronic payment system, Mesabliss and the Points of Sale have installed an e-commerce payment gateway from Shopify. All data provided to Mesabliss and the Points of Sale for these purposes are encrypted to ensure maximum security. They are hosted on a secure server certified according to the "Secure Socket Layer" (SSL) protocol. In no case will the data provided by Customers through the payment gateway be stored, and will only be retained while the purchase is made, payment is processed and until the withdrawal period has elapsed.

6.3 Mesabliss and the Points of Sale reserve the right to cancel the username and password, and therefore access to the Online Channel, for those users who have outstanding or unpaid balances with any Point of Sale.
